By accessing and using the Yeyecar app and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

3. Eligibility Requirements

To use our services, you must:

• Be at least 21 years of age
• Hold a valid driving license for at least 2 years
• Provide valid identification documents
• Have a valid payment method
• Complete the identity verification process

4. Rental Terms

4.1 Booking and Payment

All bookings must be made through the Yeyecar app. Payment is processed at the time of booking. The rental price includes full insurance coverage with zero deductible and unlimited mileage.

4.2 Cancellation Policy

Free cancellation is available up to 24 hours before the rental start time. Cancellations within 24 hours are non-refundable in accordance with Spanish consumer law (Real Decreto Legislativo 1/2007).

4.3 Vehicle Use

The rented vehicle may only be used:

• Within the island of Tenerife, Canary Islands
• By the registered driver only
• For lawful purposes
• In compliance with all traffic laws and regulations

4.4 Fuel Policy

The vehicle must be returned with the same fuel level as at pickup. If not refueled, a refueling charge will apply based on the amount consumed plus a service fee.

4.5 Return

The vehicle must be returned to the designated area within the same municipality where it was collected, parked legally and safely. Late returns may incur additional charges.

5. Insurance and Liability

All rentals include comprehensive insurance coverage with zero deductible, covering vehicle damage, third-party liability, and theft. However, you are responsible for:

• Damages caused by negligence or misuse
• Traffic fines and penalties
• Loss of keys or access devices
• Damages caused while under the influence of alcohol or drugs

6. Prohibited Uses

The following are strictly prohibited:

• Driving outside Tenerife or taking the vehicle off-island
• Subletting or lending the vehicle to others
• Using the vehicle for commercial purposes without authorization
• Driving under the influence of alcohol or drugs
• Racing, competitions, or illegal activities
• Smoking in the vehicle
• Transporting more passengers than the vehicle is designed for

7. User Responsibilities

You agree to:

• Inspect the vehicle before use and report any damage
• Lock the vehicle when unattended
• Comply with all traffic laws and parking regulations
• Report accidents or damage immediately
• Keep the vehicle clean and in good condition
• Return the vehicle on time and in the same condition

8. Service Availability

Yeyecar reserves the right to modify, suspend, or discontinue any aspect of the service at any time. We do not guarantee that the service will be uninterrupted or error-free.

9. Limitation of Liability

To the extent permitted by Spanish law, Yeyecar S.L. shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability is limited to the amount paid for the rental.

10. Governing Law and Jurisdiction

These terms are governed by Spanish law. Any disputes arising from these terms or use of our services shall be subject to the exclusive jurisdiction of the courts of Santa Cruz de Tenerife, Spain, in accordance with Spanish Civil Procedure Law.

In accordance with EU Regulation 524/2013, consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website or app. Your continued use of the service constitutes acceptance of the modified terms.
